51 year old man sentenced to 30 years for raping, impregnating a minor

A 51-year-old man has been handed a 30 year jail term for repeatedly raping a minor and impregnated her.

In 2016, Ngoloma Kakenyi Mulinge raped the then 12-year-old girl at Vikwatani in Kisauni who is now 15 years and lives at a Malindi rescue centre.

The victim’s son, Hassan matano is now a year old.

Shanzu Law Court Senior Principal Magistrate Diana Mochache said Mulinge “deserved no mercy”.

“You should have been satisfied with your wife or look for an older woman and not a minor” she told the court before throwing Mulinge into jail.

Mochache said the victim was younger than Mulinge’s first born aged 23.

Muslims for Human Rights-MUHURI in 2016 filed a case in court after rescuing the girl.

Mochache said the case was proved beyond reasonable doubts.

“Doctors report showed Matano is your son, the degree of confidence is 99.99 per cent,” Mochache said.

She further told the court that Mulinge never disputed the doctor’s report.

Mochache noted that the girls’ life has been ruined and she now lives in a rescue center for fear of being debilitated or abducted by the accused.

“Defilement is punishable by a sentence of not less than 15 years. I hereby double that sentence and hand you 30 years in prison,” said the senior Principal magistrate.

Mochache thrashed Mulinge’s pleas that he is a family man and father of four.

MUHURI Field officer Topister Juma said the child used to wash utensils at the accused home and earned Sh 20.

“Because of poor background, she had to comply. She was raped thrice and impregnated. Topister sought urgent medical attention and counseling for the minor who could not cop with the physical and psychological pain.

Topister revealed that the minor’s family lived at Vikwatani, Kisauni.

Juma said the pregnancy was spotted after four months. The victim, a class four pupil, received psycho-social support.

Mulinge has 14 days to appeal.
