Three suspects linked to the death of former Kilifi County Deputy governor Kenneth Kamto will remain in custody for nine more days.
Shanzu law courts senior resident magistrate Yusuf Shikanda on Tuesday said that the three suspects are not represented by any advocate which is against their legal right.
Shikanda said that the case revolves around robbery with violence which attracts death penalty and it will be unfair for the hearing to continue without the three accorded legal representation.
Shikanda said the suit against the three Julius Gitonga, Joseph Amwayi and Florence Mwanza Mbithe will only proceed when the three are accorded legal representation.
“I also decline to rule on the bond application from the state counsel until the three are properly represented in court by an advocate,” Shikanda told the court.
He further urged the committee on pro-bono services to look into the issue.
Earlier the state counsel led by Shakwila Ayekha appealed to the court to deny the three bond saying that they have been convicted and jailed following criminal records, but they were freed after an appeal.
Ayekha further said that the three are also linked to another criminal incident at Ganze in Kilifi County which is still under investigation.
“These three are not good citizens they have a criminal record and they should be denied bond or bail,” noted Ayekha.
The case will be mentioned on February, 14th.
