Mtwapa family evicted from their ancestral land appeal for help

The family of the late Mzee Charo Baha is calling on the government to intervene after it was left homeless and also lost property worth millions of shillings after their living and rental houses were demolished by a private developer at Mzambarauni village in Mtwapa Township, Kilifi Kilifi County.

The family members are currently sleeping in the cold after hired goons armed with crude weapons under the guard of Mtwapa police officers ordered the family and tenants out of their houses before a bulldozer flattened the houses.

The family of the late Charo led by his three sons Reynold Karisa, Ismail Charo and Haroun Tete said they were woken up at the wee hours of morning by the rubble of a bulldozer and banging doors of police officer who were accompanied by hired goons and were ordered to vacate their dwellings.

According to Ismail Charo the last born sons of the late Mzee charo a private unscrupulous land grabber John Nyagaka Osoro started terrorising them after their mother died, he would invade their one-acre prime plot along Kilifi-Malindi road under the guard of police officers and started demarcating it without their knowledge.

Ismael said they smelled a rat when their mother died, Osoro brought a court order barring them from burying their diseased in their ancestral land which they have occupied since 1943 when their late father bought it and they had to seek intervention from their local administration to bury their mother.

Painful tears

Ismael who shed tears when addressing journalists at the disputed land pointed an accusing finger to Mtwapa police station OCs for being used by Mr. Osoro to deprive them of their inheritance and their only source of income through rental of business premises.

Reynolds Karisa, the late Mzee Charo Karisa eldest son said they had occupied the land for more than 60 years and inherited it after their both parents died.

According to Reynold, land grabber and speculator bought a plot to build a house from their neighbor in 1991 but without their knowledge he colluded with Kilifi County land officers, doctored a fake title deed and he now wants to take their land through a mixture of forgeries and coercion.


Reynold says, Mr. Osoro is a cabal of land hungry, well-connected and informed person who continues to hold dozens of families and individuals in Kilifi County at ransom through well-orchestrated schemes to dispossess them off of their property through his dubious scheme of colluding with police officers and land registry officers.

According to Reynold, after they realised there is a hatched scheme by Mr.Osoro to deprive them their land they moved to Kilifi Law Courts where they obtained a court stay order till the case is determined on May, 6 this year Justice Mulei Kituku barring any development till their case is determined and they served their plaintiff Mr. Osoro and also OCs Mtwapa Police Station.

Haroun Tete, another Charo’s son says they have scrutinised the title deed used by Osoro to deprive them of their inheritance and found to be fake.

According to Haroun, the fake title deed being used by Osoro indicates he bought the land in 1992 after one year of settlement in their village but their family original title deed is dated 1942 and their land has never changed hands to another person through sale or inheritance.

The family is now appealing for intervention through the government to help in salvaging their land from the unscrupulous land grabber who is using police officers to silence and intimidate them.
